Atlanta Trial Law Firm Obtains Seven-Figure Verdict in Dekalb County Case
(January 25, 2016) ATLANTA, GA — A DeKalb County jury returned a $3 million verdict in favor of the family of Brenda Davis, a 64-year-old woman who died two days after minimally-invasive gynecological surgery. The jury found that medical negligence on the part of the defendant gynecological surgeon caused her untimely death following this routine surgical procedure.
Atlanta-based personal injury firm Pope & Howard, P.C. represented the Davis family and won the case by proving that the surgeon was negligent in failing to address the victim’s symptoms after surgery. During a minimally-invasive procedure to remove an ovarian cyst, the victim’s bowel was pierced. After surgery, the patient’s symptoms were misidentified, ultimately leading to her death.
“We were fortunate to represent a wonderful family against outstanding defense attorneys in a very hard-fought medical malpractice case,” said Geoff Pope, co-founder and partner at Pope & Howard, P.C. “It has been a long journey, but the Davis family remained strong throughout the ups and downs of the litigation. Our team is honored to represent them.”
The jury found the gynecological surgeon negligent in failing to inspect the bowel adequately for cuts —an accepted danger of this particular surgery—and in his mishandling of the victim’s complaints after the procedure. By failing to identify the danger of her symptoms, the surgeon made a fatal error that violated the standard of care for his patient and ultimately led to her death.
“We are glad we can offer some measure of justice to our clients after their loss. This was a tragic case of a patient who should have been able to continue to live a long and happy life after a minimally-invasive procedure, but her life was cut short due to a number of medical errors,” said Marc Howard, co-founder and partner at Pope & Howard, P.C.
