Jury Awards Settlement Against Henry Medical Center for Delivery Negligence
(September 4, 2014) ATLANTA, GA— Atlanta trial law firm Pope & Howard, P.C., representing the family of a 7-year-old girl who suffered brain damage as a result of a delayed delivery, obtained a $3 million award after a jury found Henry Medical Center liable for negligence.
Following a two-week trial in the Fulton County court system, the jury found that a labor and delivery nurse, along with a certified nurse midwife, failed to quickly contact a doctor after noting fetal distress. As a result, an emergency C-section was delayed, exposing the baby to prolonged oxygen deprivation and causing irreversible brain damage. The child now suffers from cortical blindness, cognitive impairments, and motor skill impairments.
Through the child’s parents, Pope & Howard, P.C. alleged that several providers at Henry Medical Center fell below acceptable standards of care. “The case allowed us to expose some deficiencies in medical care at Henry Medical Center, and to hopefully prevent a similar incident from happening again in the future,” said Marc Howard, partner.
The incident occurred at Henry Medical Center in 2007, which is now owned by Piedmont Healthcare. “After seven years, we now have a just verdict for our clients,” Howard added.
The jury took a little over three hours to deliberate, ultimately determining that the nurse and midwife were liable.
